By downloading, installing, or using UFITT Competition ("the App"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the App.

You must be at least 13 years old to use this App. By using the App, you represent that you meet this age requirement.

BY USING THIS APP, YOU ACKNOWLEDGE AND AGREE:

• You are physically fit and capable of performing the exercises featured in this App.
• You have consulted with a healthcare provider if you have any medical conditions, injuries, or health concerns that may affect your ability to exercise safely.
• Physical exercise carries inherent risks, including but not limited to muscle strains, joint injuries, cardiovascular events, and in rare cases death.
• UFITT Competition, its owners, developers, and affiliates are NOT liable for any injury, illness, medical emergency, or death that occurs during or as a result of using this application.
• You voluntarily assume all risks associated with participating in exercise activities through this App.
• You will not use this App if you are under medical restriction from exercise without prior approval from your physician.

• You must provide accurate information when creating your account.
• You are responsible for maintaining the security of your account and password.
• You may not create multiple accounts to manipulate leaderboards or rankings.
• You may not use another person's account without their explicit permission.
• One account per person — creating duplicate accounts to exploit progression systems is prohibited.
• Accounts found to be bots, automated scripts, or non-human users will be terminated immediately.

The following behaviors are strictly prohibited and will result in immediate account termination:

• Using any tool, script, bot, or software to artificially inflate rep counts or performance metrics
• Tampering with, reverse-engineering, or modifying the App's code or data
• Exploiting bugs or glitches to gain unfair competitive advantages
• Misrepresenting physical performance or submitting fraudulent competition results
• Harassment, abuse, or threatening behavior toward other users
• Posting offensive, illegal, or inappropriate profile content
• Sharing or selling your account credentials
• Using the App for any illegal purpose

UFITT Competition offers free and paid subscription tiers (Prime Basic, Prime Pro, Prime Elite, Prime Apex). Subscriptions are billed monthly through the App Store or Google Play.

• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.
• Refunds are subject to App Store / Google Play refund policies.
• We reserve the right to change subscription prices with 30 days' notice.
• Cancelling a subscription does not entitle you to a refund of unused periods.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

You may NOT:

• Copy, modify, or distribute the App or its content
• Reverse engineer, decompile, or disassemble the App
• Use the App to build a competing product or service
• Remove or alter any proprietary notices in the App
• Sublicense or transfer your rights to any third party

Software Glitches During Live Events: UFITT Competition is provided "as is." We do not warrant that the App will be error-free or uninterrupted. We are not liable for any loss of data, competition results, or prizes resulting from technical failures, network outages, server downtime, or any other technical issues during live events or competitions.

All content in the App — including but not limited to the UFITT Competition logo, alien characters, soundscapes, artwork, and software — is owned by or licensed to UFITT Competition and is protected by copyright, trademark, and other intellectual property laws.

You retain ownership of content you submit (e.g., profile photos), but grant us a worldwide, royalty-free license to use, display, and distribute such content within the App.

We reserve the right to suspend or permanently terminate any account at our sole discretion, including but not limited to accounts that:

• Violate any provision of these Terms
• Engage in cheating or manipulation of the competition system
• Are found to be fraudulent, abusive, or harmful to the community
• Have been inactive for more than 24 months

Upon termination, your access to the App and all associated data will be removed. Subscription fees paid prior to termination are non-refundable where permitted by law.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UFITT COMPETITION AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING FROM YOUR USE OF THE APP.

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify users of material changes via email or in-app notification.
